Terms of Service

These Terms of Service outline the terms, responsibilities, and expectations between RED. (“RED,” “we,” “us,” or “our”) and clients who use our services.

1. Introduction

By engaging RED. for our services, you agree to these Terms of Service. These terms apply to all projects, services, and engagements between RED. and its clients.

If you do not agree with these terms, please do not proceed with our services.

2. Services

RED. provides creative and digital services, which may include content strategy, video production and editing, social media content, branding, creative direction, and related services.

The exact scope of each project, including deliverables, timelines, pricing, and revisions, will be agreed upon with the client before work begins.

3. User Responsibilities

To ensure projects are completed effectively, clients are responsible for:

Providing accurate information, content, assets, and requirements necessary for the project.

  • Providing timely feedback and approvals.

  • Ensuring that any materials supplied to RED. are legally permitted to be used.

  • Communicating any changes to the agreed project scope as early as possible.

Delays in receiving required information, assets, feedback, or approvals may affect the agreed delivery timeline.

4. Payments and Refunds

Payment terms will be agreed upon before the start of each project.

Depending on the project, RED. may require a deposit or full payment before work begins.

Additional work outside the agreed scope may be charged separately.

Unless otherwise agreed in writing, payments are non-refundable once work has commenced, particularly where time, resources, or deliverables have already been committed to the project.

5. Revisions and Approvals

The number of revisions included in a project will depend on the agreed scope.

Feedback should be provided clearly and within a reasonable timeframe. Requests that substantially change the original direction or scope of the project may be treated as additional work and may incur additional charges.

Once a deliverable has been approved by the client, further changes may be charged separately.

6. Intellectual Property

Unless otherwise agreed in writing, RED. retains ownership of its pre-existing materials, processes, templates, concepts, working files, and internal resources used during a project.

Upon receipt of full payment, the client receives the agreed rights to use the final deliverables produced specifically for them.

Third-party assets, fonts, music, stock footage, software, or other licensed materials remain subject to their respective licensing terms.

Source/project files are not automatically included unless specifically agreed upon.

7. Confidentiality

Both RED. and the client agree to treat confidential information shared during a project responsibly and not disclose it to third parties without permission, except where disclosure is required by law.

8. Portfolio and Marketing Use

Unless otherwise agreed in writing, RED. may showcase completed work created for a client in its portfolio, website, social media, presentations, and other promotional materials.

If a project contains confidential or unreleased information, the client may request that RED. not publicly showcase the work until an agreed date.

9. Limitation of Liability

RED. will make reasonable efforts to deliver services to the agreed standard and within the agreed scope.

However, RED. does not guarantee specific business results, including revenue, leads, followers, or other performance outcomes, unless explicitly agreed in writing.

RED. will not be liable for indirect or consequential losses arising from the use of our services.

10. Termination

Either party may terminate a project or ongoing engagement by providing written notice.

If a project is terminated after work has begun, the client remains responsible for payment for work completed and expenses incurred up to the termination date.

11. Changes to These Terms

RED. may update these Terms of Service from time to time. The latest version will be made available on our website.

Continued use of our services after changes have been published constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws applicable to RED.'s registered jurisdiction. Any disputes shall be subject to the applicable courts and legal authorities of that jurisdiction.
